In these interrogatories blank audio recording media refers to:

 

(i) Audio cassettes (1/8 inch tape) of 40 minutes or more in length;

(ii) Recordable compact discs (CD-R, CD-RW, CD-R Audio, CD-RW Audio or any other type of recordable or rewritable compact disc) of 100 megabytes or more of storage capacity;

(iii) MiniDiscs

(iv) Removable electronic memory cards, removable flash memory storage media of any type, and removable micro-hard drives (Microdrive and any similar removable hard drive);

(v) Recordable digital versatile discs (DVD-R, DVD-RW, DVD+RW, DVD-RAM or any other type of recordable or rewritable DVD);

(vi) Non-removable electronic memory cards or non-removable flash memory storage media of any type incorporated into an MP3 player or into any similar device with internal electronic or flash memory that is intended for use primarily to record and play music;

(vii) Non-removable hard drives incorporated into an MP3 player or into any similar device with an internal hard drive that is intended for use primarily to record and play music.

 

If you are involved significantly in the music industry, as an independent, amateur or hobbyist in any capacity, please respond to the questions in Part B only. Otherwise, respond only to the questions in Part A.

 

PART A: NON-MUSIC RESPONDENTS

 

  1. Have you filed your objection primarily on the basis of the impact of the levy on you personally, and any organization you are involved with, or based primarily on the overall impact of the levy on Canadians, or on your belief that the levy is in principle unfair and unjustified, or based primarily on some other reason? In addition to your primary reason for objecting, what other reasons led you to object?

  3. Please identify and, wherever possible, provide copies of all articles, statistical data, research studies, or other information you relied upon in reaching your decision to file an objection. What other factors influenced your decision?

  5. Please describe the way in which you personally and/or any organizations you are involved with, has been affected by the existing levy, in effect in 2001 and 2002, or will be affected by the proposed levy for 2003-2004.

  7. Based on the definition of blank media identified above, what types of blank audio recording media did you purchase in 2000, 2001 and 2002. For each type of blank audio recording medium you have purchased what quantity would you estimate you purchased in 2000, 2001 and 2002?

If you are sufficiently familiar with the price at which each type of blank audio recording medium has been and is available, at what price would you estimate that each type of blank audio recording medium was available in 2000, 2001 and 2002? If you cannot provide such estimates what is your perception of the trend in prices for each type of medium? Have prices been stable over this period? Have they increased or decreased a little, quite significantly, or very substantially?

  11. Please describe the audio recording equipment and software (CD writer, DVD writer, etc.) you now own that could be used to copy recorded music. How likely are you to buy additional audio recording equipment or software in the forseeable future? If you are likely to buy additional audio recording equipment or software, what type(s) are you most likely to buy?

  13. What use(s) have you made of the blank audio recording media you have purchased? Does anyone else in your family or household make use of them? Are they used to make copies of recorded music? How often?

If you, or someone else in your family uses blank audio recording media to make copies of recorded music, please indicate for each type of blank medium whether copies are made in an MP3 or another compressed format? What percentage of your copying of recorded music on each type of medium would be of MP3 or other compressed music files?

  17. Would you say that you are familiar with the concerns of songwriters and composers, recording artists and producers of sound recordings over the copying of music onto blank tape and other media? Please describe your understanding of these concerns.

What is your understanding of the way the royalties collected from the levy are distributed among the authors (songwriters and composers), performers, and producers of sound recordings who are the beneficiaries of the levy? Are you aware of the percentage of the royalties allocated to each of the three classes of copyright owners who are involved in creating recorded performances of musical works?
